Terms of Service

These Terms of Service (“Terms”) govern your use of SkyISO (“SkyISO”, “we”, “us”, or “our”), an aviation photography community operated by Martin Hettlinger (“Operator”). By creating an account, purchasing access, or using SkyISO, you agree to these Terms, our Privacy Policy, our Community Guidelines, and our Impressum (Legal Notice).

1. Eligibility

You must be at least 16 years old (or the minimum age required in your country to consent to data processing) to use SkyISO. If you are under 18, you confirm that you have permission from a parent or legal guardian.

3. User Content

SkyISO allows you to upload, share, like, comment on, vote for, and message about aircraft photos and videos (“User Content”). You retain ownership of your User Content, but you grant SkyISO a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your User Content solely to operate and promote the service.

Each upload constitutes your confirmation of the rules in our Upload confirmation (Community Guidelines). You represent and warrant that:

3.1 Sharing links (not downloads)

SkyISO provides a Share link feature so you can send a URL to a post (format /p/{postId}). Shared links include pilot credit in the share text. Messengers may show a preview (title, description, thumbnail) generated from public post metadata.

3.2 Your responsibility for uploads

You alone are responsible for all content you upload, publish, comment on, vote for, or send in messages (“your content”). SkyISO provides hosting and community tools; the Operator does not create, edit, endorse, or pre-approve your uploads.

Before every upload, you confirm that your content is lawful and permitted. In particular, you are responsible for ensuring that your content:

Because SkyISO cannot practically review every upload in advance, you upload at your own responsibility. If your content breaks the law or third-party rights, you — not the Operator — bear the primary legal responsibility, subject to mandatory laws that cannot be excluded.

The Operator acts as a hosting/intermediary service provider. We are not obliged to monitor all user content before publication. We provide reporting and blocking tools and will review valid reports and legal notices (including copyright and illegal-content notices) and may remove content or suspend accounts. This does not shift your responsibility as the uploader.

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless the Operator from claims, damages, costs, and reasonable legal fees arising from your content or your breach of these Terms, except where such limitation is not permitted by mandatory consumer or platform law.

4. Paid Access & App Store Purchases

SkyISO may be offered as a paid app and/or with in-app purchases or subscriptions through the Apple App Store. Unless stated otherwise at the point of purchase:

Refund requests for App Store purchases must be submitted to Apple according to Apple’s refund policies. The Operator cannot issue refunds for purchases made through Apple’s billing system. For billing questions, contact Apple Support or use reportaproblem.apple.com.

4.3 Right of withdrawal (EU consumers)

If you are a consumer in the European Union, you generally have a 14-day right of withdrawal for distance contracts. For digital content delivered immediately (app download or instant access), this right may be lost if you:

  1. expressly consent to immediate performance before the withdrawal period ends, and
  2. acknowledge that you lose your right of withdrawal once delivery begins.

Apple’s purchase flow may include such confirmations. If you have not yet started using paid digital content, you may still contact Apple regarding withdrawal or refunds within applicable legal limits.

4.4 Access & distribution

SkyISO requires a registered account to use community features (feed, upload, voting, messaging). The iOS app may be offered as a paid download on the Apple App Store; payments are processed by Apple. Web and app access may be limited or unavailable during maintenance or pre-release periods.

5. Prohibited Conduct

You may not use SkyISO to upload, share, or promote content or behavior that is:

6. Voting & Rankings

Each account may cast one photo vote and one video vote per calendar month for other users' uploads only. You may not vote for your own posts. Vote manipulation, fake accounts, or automated voting is prohibited and may result in removal from rankings and account suspension.

7. Moderation & Enforcement

Zero tolerance: SkyISO has zero tolerance for objectionable content and abusive users. Sexual content, violence, hate speech, harassment, spam, copyright violations, and non-aviation material are prohibited.

We review user reports and block notifications and aim to act within 24 hours, including removing reported content and suspending or permanently banning accounts that violate these Terms.

Paid access does not exempt an account from moderation. We are not obligated to monitor all content in advance, but we provide reporting and blocking tools and respond to valid reports.

8. Reporting & Blocking

Users can report posts, comments, or other users through the in-app report feature (⋯ menu on posts). Users can also block other users — blocking immediately removes that user's content from the blocker's feed and notifies the Operator for review. Reports and blocks are reviewed by the Operator within 24 hours where possible.

9. Copyright, Trademarks & Takedowns

9.1 Copyright infringement notice

If you believe content on SkyISO infringes your copyright, send a notice to skyiso.support@gmail.com with:

  1. your name and contact details;
  2. identification of the copyrighted work you claim is infringed;
  3. the URL or enough detail to locate the material on SkyISO (post link, author name, date);
  4. a statement that you have a good-faith belief the use is not authorized;
  5. a statement that the information in your notice is accurate and, under penalty of perjury where applicable, that you are the rights holder or authorized to act on their behalf;
  6. your electronic or physical signature.

We review valid notices and may remove or disable access to the reported content. We aim to respond within a reasonable time. Where content appears clearly illegal under applicable law (including EU Digital Services Act requirements), we may act faster.

9.2 Repeat infringers

Accounts that repeatedly upload infringing content may be suspended or permanently banned.

9.3 Trademarks & third-party brands

Aircraft liveries and airline logos may appear incidentally in spotting photos. Users must not use SkyISO to imply endorsement by airlines, airports, manufacturers, or other brands, and must not misuse third-party trademarks in profiles or posts. Trademark complaints may be sent to the same contact address with details of the mark and the allegedly infringing use.

9.4 SkyISO software & design

The SkyISO name, logo, app interface, and built-in music/sound elements are owned by the Operator or licensors. You may not copy, scrape, or reverse-engineer the service to create a confusingly similar product.

10. Privacy

Our Privacy Policy explains how we collect, use, and store personal data, including account data, uploads, likes, comments, votes, and messages.

11. Service Availability

SkyISO is provided on an “as is” and “as available” basis. We may change, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability.

12. Disclaimer & Limitation of Liability

To the fullest extent permitted by law, SkyISO and the Operator are not liable for user-generated content posted by users, indirect damages, loss of data, or service interruptions. User content is the responsibility of the uploading user (see §3.2). Nothing in these Terms limits liability where such limitation is not permitted by applicable law (including mandatory consumer rights in your country).

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date and version. Continued use after changes means you accept the updated Terms where permitted by law.

14. Governing Law

These Terms are governed by the laws of Austria, without regard to conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected where applicable.
